Zealand Impressions – Contract with
You
New Zealand
Impressions wish to set out clearly the mutual obligations and responsibilities
between us when a contract is entered into. A contract will exist as soon
as New Zealand Impressions confirms your booking.
The items
included in each tour are clearly stated on the itinerary, written quotation or
website. All other expenses including but not by way of limitation such
as, international flights, laundry, visa/passport fees, telephone and
communication costs, taxi fares, excess baggage charges, travel insurance, and
all other matters of a personal nature are not included and must be paid for
separately by you.
Deposit
To confirm your
booking, New Zealand Impressions requires a 10% deposit for each person
traveling. Full and final payment
will be required 60 days before arrival in New
Zealand
. A credit card number is required to
confirm your booking. This will be held on file. In the event of any
unpaid service charges, you incur, while you are travelling with us, this card
will be debited the amount due.
Booking
Cancellations
The
following cancellation and forfeiture provisions will apply –
1.
Tours
cancelled 60 - 40 days prior to departure will result in forfeiture of the 10%
deposit. If additional charges have been incurred for accommodation or
service providers (eg booked domestic flights) those additional
charges may also be deducted from the 90% refund due to
you.
2.
Tours
cancelled 39 - 15 days prior to departure will result in forfeiture of 50% of
the total tour cost. If additional charges have been incurred for
accommodation or service providers (eg booked domestic flights)
those additional charges may also be deducted from the 50% refund due to
you.
3.
If you cancel your tour less than two weeks (14
days) prior to departure 100% of your total tour cost will be forfeited.
No additional charges however will be levied.
Insurance
New Zealand
Impressions strongly recommends that you arrange comprehensive travel insurance
at the time you book your trip. New Zealand Impressions will not be
responsible for arranging any travel insurance.
Refunds
No refunds will
be made on any un-used or partially-used sections of your itinerary once travel
has commenced, except in extenuating circumstances. Your own travel insurance
may provide cover.
New Zealand Impressions will
not be liable for any refunds for un-used or partially-used travel arising from
the unlikely need to change any arrangements to ensure the safety and/or further
participation and enjoyment of your holiday.
Cancellations or Changes by New Zealand Impressions
While it is
unlikely that New Zealand Impressions will need to make any changes to your
confirmed itinerary, sometimes this is unavoidable. Accordingly,
notwithstanding anything otherwise provided in this Agreement, New Zealand
Impressions reserves the right to, amend itineraries, or to cancel arrangements,
in the event that it is required to do so, as a result of circumstances arising
outside of its control. New Zealand Impressions will make alternative
arrangements, and to a similar value, when it is reasonably practical to do
so.
Accommodation Changes
New Zealand
Impressions reserves the right to substitute any hotel/lodge/B & B outlined
in your confirmed itinerary, should circumstances necessitate it to do so.
Should any such substitution occur, then the accommodation provided will be of a
similar standard.
Itinerary
Changes
In the event
that itineraries require alteration as a result of weather, transport
cancellation or delays or any other factors beyond New Zealand Impressions
direct control, no liability will be accepted by New Zealand Impressions for any
additional expenses incurred.
Travel
Documents
It is your own
responsibility to ensure that all necessary travel documents (eg passport,
visas) are valid and effective for the purposes of your tour.
Law and
Jurisdiction
Any matters
arising in relation to your contract with New Zealand Impressions will be
governed by
New Zealand
law and subject to the jurisdiction of
the Courts of New Zealand.
Force
Majeure
Compensation
will not be payable by New Zealand Impressions if it needs to cancel or change
your travel arrangements in any way for reasons of war, threat of war, riot,
civil strife, industrial dispute, terrorist action, natural or nuclear disaster,
fire, adverse weather conditions or other circumstances amounting to force
majeure in law.
Liability
New Zealand
Impressions will not be liable for any loss or damage to luggage or personal
effects. New Zealand Impressions will not be liable for any personal
injury or death to a passenger arising whilst traveling with New Zealand
Impressions or any of its nominated suppliers. Some of the activities
listed as options or included in tours involve an element of risk. New
Zealand Impressions gives notice that it will not be liable for any damage,
personal injury or death arising as a result of any of those
activities.
Confirmation of Your
Booking Signifies Acceptance of these Terms and Conditions.
New
Zealand Impressions is a trading name of Discovery Travel Ltd, a limited
liability company incorporated under the laws of New Zealand.
